CarBuyerUSA - Can I Sell My Car If Someone Else Is Also on the Title?

Two Names on the Title? Before You Sell The Car, You'd Better Know What's Between Them.

You own the car. You make the payments. You insure it. You drive it every day, so you should be able to sell it whenever you want, right? Not necessarily.

If another person's name appears on the title, that second name can completely change what is required to sell the vehicle. It might be your spouse, ex-spouse, parent, adult child, former partner or someone who helped you purchase the car years ago.

And one tiny word printed between those names—AND or OR—can become a very big deal.

FIRST, READ THE TITLE — NOT YOUR RELATIONSHIP STATUS

A vehicle title establishes ownership. Who drives the car most, who pays the insurance or whose driveway it occupies doesn't automatically determine who has authority to sell it. When two owners appear on a title, look carefully at how their names are connected.

The exact rules vary by state, but the distinction can be critical. For example, Nevada DMV guidance states that when owners are joined by AND, both owners must sign to release their interest. When they're joined by OR, either owner may sign alone. Other states can use different conjunctions, formats or signature rules.

Do not look at “AND” or “OR” and assume every state handles it identically.

TWO OWNERS CAN CREATE VERY DIFFERENT SELLING SCENARIOS

What's on the Title / Situation
What You Need to Find Out Before Selling
Your Name AND Spouse's Name
Both signatures may be required to release ownership
Your Name OR Spouse's Name
One owner may be permitted to sign, depending on the issuing state's requirements
Parent AND Adult Child
Both may need to participate even if only one person drives or paid for the vehicle
Parent OR Adult Child
One may be able to complete the transfer, depending on state title rules
You AND an Ex-Spouse
Divorce doesn't automatically erase a name from a vehicle title
Divorce decree awards you the vehicle
Additional documentation or retitling may still be necessary; the decree should clearly identify the vehicle where required
Co-owner is deceased
Death certificate, estate documents or surviving-owner procedures may apply
Co-owner cannot be located
Don't assume you can simply sign around them; title guidance may be necessary
Co-owner refuses to sign
If their signature is legally required, you may not be able to complete the sale without resolving the ownership dispute
Names separated by AND/OR
Requirements can differ from a simple AND or OR designation
Names separated by a slash or no conjunction
The issuing state's rules determine what that format means and whose signatures are required
One owner's name has changed
Marriage certificate, divorce decree or other legal name-change documentation may be necessary
Vehicle still has a lien
Lender/payoff requirements must also be addressed
Paper title is missing
A duplicate title may be required from the state that issued it
Power of Attorney is being used
It must meet applicable title-transfer requirements; don't assume any generic POA will work
Title is from another state
The rules of the issuing jurisdiction matter—don't rely solely on the rules where you currently live

The lesson here is brutally simple: Don't wait until you've agreed to sell the car to discover that somebody else's signature is required.

“BUT THAT'S MY EX-SPOUSE'S NAME!” This is where things can get ugly.

Maybe you've been divorced for five years. Maybe the divorce decree says the vehicle belongs to you. Maybe your ex hasn't touched the car since 2021. That does not mean you should simply ignore their name on the title.

Title requirements and divorce documents have to be reconciled correctly. Nevada, for example, specifically advises that when a divorce decree is being used to establish vehicle ownership, the decree must specifically award the vehicle by VIN.

The same caution applies to parents and children. Dad may have only gone on the title to help his daughter buy the car. Ten years later, Dad's name may still matter when she wants to sell it.

DON'T GUESS. SEND THE TITLE TO SOMEBODY WHO DEALS WITH THIS.

This is exactly where CarBuyerUSA can help. If you're unsure whether both owners need to sign, whether your divorce paperwork is sufficient, whether a Power of Attorney can be used, or what to do because the other owner is deceased or unavailable, contact the CarBuyerUSA team and tell us what you're dealing with.

Send us the title and the documents you have. Our title administrator can review the situation and let you know what additional documentation may be needed to complete the sale.

That is a whole lot smarter than assuming everything is fine and discovering the problem when you're ready to get paid.

TWO NAMES DON'T AUTOMATICALLY MEAN YOU CAN'T SELL

A jointly titled vehicle can absolutely be sellable. The question is whether the people and paperwork required to release ownership are in place.

Once you've established what your particular title requires, go to CarBuyerUSA.com and find out what the vehicle could be worth. Our team buys vehicles nationwide, so you can handle the title question and the selling question with the same team.

Don't let an AND, an OR, an ex-spouse or a title you haven't looked at in six years turn a straightforward vehicle sale into a last-minute disaster.

Get the title out. Read exactly what's on it. If you're confused, let our title administrator review it. Then let CarBuyerUSA.com help you get the paperwork handled and the vehicle SOLD.
